1. Introduction and Agreement

1.1 About These Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders, and developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement shall prevail.

1.3 Acceptance of Terms

By accessing or using our services you acknowledge you have read and understood these Terms, agree to be bound by them and our Privacy Policy, represent that you are at least 18 years of age, and represent that you have the authority to enter into this agreement. If you do not agree with these Terms, you must immediately cease using our services.

1.4 Changes to Terms

We reserve the right to modify these Terms at any time. We will update the "Last Updated" date, notify registered users via email, and prominently display material changes. Changes take effect immediately upon posting unless otherwise specified. Your continued use constitutes acceptance.

2.2 Nature of Service

Information Platform: HALP is an information and advertising platform. We facilitate connections between property seekers and providers, aggregate and display property and business information, and provide research tools. We are not a real estate agent, developer, builder, or financial advisor.

Lead Routing: Property listing inquiries go directly to the listing agent, developer, or builder — HALP does not store or process them. Platform inquiry forms (Contact Us, Join Us, Advertise With Us) are collected and managed by HALP in Pipedrive/ActiveCampaign and Google Drive under our Privacy Policy.

No Agency Relationship: HALP does not act as your agent, provide advice, bind you to any transaction, guarantee the accuracy of third-party listings, or control how listing agents use your inquiry information.

2.3 Service Availability

Services are provided "as is" and "as available". We may modify, suspend, or discontinue services at any time. Scheduled maintenance may cause temporary interruptions.

Platform Infrastructure: AWS (hosting & backups), Synergywholesale (domain hosting), Google Workspace (business email), Stripe (payments), Pipedrive and ActiveCampaign (CRM), Zapier (automation). Providers may change from time to time.

3. User Accounts and Registration

You must provide accurate information, maintain the confidentiality of your credentials, be at least 18, create one account per person, and provide a valid ABN/ACN for business accounts. You are responsible for all activity under your account. We may suspend or terminate accounts that breach these Terms, provide false information, are used for fraudulent activity, fail to pay fees, or remain inactive. You may terminate your account at any time by contacting support@halp.com.au.

4. User Conduct and Prohibited Activities

You agree to comply with applicable laws, use services only for lawful purposes, provide accurate information, respect intellectual property, and act in good faith.

You must not:

Use bots, scrapers, or robots without authorization; interfere with the platform; attempt unauthorized access; reverse engineer components; circumvent security.
Post false, misleading, or deceptive information; upload malware; transmit spam; engage in phishing; impersonate others.
Violate laws, infringe intellectual property, engage in money laundering or fraud, facilitate illegal transactions, or violate consumer protection laws.
Harass, threaten, discriminate, violate privacy, or engage in stalking.
Resell services without authorization, compete with our business, aggregate our listings, or create multiple accounts to circumvent restrictions.

Violations may result in suspension or termination, removal of content, legal action, reporting to law enforcement, or permanent ban.

5. Property Listings and Information

Property listings are provided and owned by third parties (developers, builders, agents, project marketers, data providers). HALP does not own or control third-party listings, verify all information, endorse any provider, or guarantee availability or pricing.

Property information may change without notice. Prices, availability, images, land sizes and school zone information are indicative only. Always verify critical information directly with the property provider before making decisions.

School Zone Information is sourced from government and third-party databases, provided for general reference, subject to change, and not guaranteed. Always verify catchments with the relevant education department and individual schools. Living in a catchment does not guarantee enrolment.

6. Business Directory Listings

To advertise, you must hold a valid ABN/ACN, be a legitimate operating business, comply with advertising laws, provide accurate information, and hold necessary licences. Listings must accurately describe your services, use your own name and logo, comply with Australian Consumer Law, and avoid misleading claims. Prohibited content includes illegal goods, false claims, bait advertising, discrimination and IP infringement.

Free Listings provide basic directory presence. Premium Subscriptions add features, require payment, auto-renew unless cancelled, and are subject to the refund policy. You must respond to inquiries promptly and lawfully, and we may remove listings for breach, credible complaints, non-payment, unlicensed activity, or prohibited content.

7. Payment Terms (Advertiser Subscriptions)

Pricing for subscriptions, listings, promotions, and add-ons is as displayed on our website and/or at checkout, or in the applicable Listing Agreement. Pricing is subject to change with 30 days' notice. All fees are in AUD; prices are displayed exclusive of GST unless otherwise stated, and GST is added at checkout where applicable.

Payments are processed via Stripe (PCI-DSS Level 1 certified), with automatic recurring billing for subscriptions and secure encrypted transactions. HALP does not store complete card numbers. Subscriptions auto-renew until cancelled. You may cancel anytime before your next billing date — no refunds for voluntary cancellations, pro-rata refunds for technical issues preventing access, processed within 14 business days. On non-payment, we may retry, suspend after 7 days, and remove listings after 14 days. You remain liable for unpaid fees.

8. Intellectual Property Rights

All content on our platforms is owned by HALP or licensed to us, including logos and trademarks ("HALP", "House And Land Packages", "Boutique Developments"), website design and functionality, software, text and graphics, and data compilations. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our platforms for personal, non-commercial purposes. You may not reproduce, distribute, modify, or use content commercially without permission.

When you submit user-generated content, you retain ownership but grant us a worldwide, royalty-free licence to use, reproduce, modify and display it, and warrant that you have the right to grant that licence.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax, or real estate advice. Calculators provide estimates only. Always consult a qualified professional. We do not control third-party conduct and are not responsible for actions of developers, agents, or brokers. We are not party to contracts between you and third parties.

Information may contain errors or become outdated. We do not guarantee continuous, error-free access. Our platform relies on third-party services (AWS, Stripe) and we are not responsible for their failures.

10. Limitation of Liability

To the maximum extent permitted by law, HALP and its representatives are not liable for direct, indirect, consequential, incidental, special or punitive damages arising from your use of our services, errors in content, third-party conduct, unauthorised access, service interruptions, or property transactions. Where liability cannot be excluded, our total liability is limited to $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid us in the prior 12 months. Nothing excludes rights under the Australian Consumer Law; where consumer guarantees apply and are not met, our liability for breach of consumer guarantees is limited (at our option) to re-supplying the services or paying the cost of having them re-supplied.

You agree to indemnify and hold harmless HALP and its representatives from claims arising from your breach of these Terms, violation of law or third-party rights, use of our services, content you submit, or interactions with other users.

11. Dispute Resolution

Before initiating legal proceedings you agree to contact legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction of NSW courts. Optional arbitration is available under ADRA rules in Sydney. To the extent permitted by law, class actions are waived. Either party may seek injunctive relief for IP infringement, breach of confidentiality, or irreparable harm.

17.2 Property Listing Inquiry Flow

When you submit a property listing inquiry, your information is sent directly to the listing agent/developer. HALP does not store, read, or process your inquiry — this applies to property listing enquiry forms. Other platform forms (Contact Us, Join Us, Advertise With Us) are handled by HALP as described in Section 17.3. The advertiser becomes responsible for your information; the advertiser's privacy policy governs their use of your data; HALP cannot retrieve, modify, or delete inquiries sent to advertisers.

17.3 Platform Inquiry Forms

Contact Us, Join Us and Advertise With Us forms are collected and stored by HALP in Pipedrive/ActiveCampaign and Google Drive under our Privacy Policy. We respond to your inquiry and may follow up.

17.4 User Acknowledgment

By using any inquiry form on our platform you acknowledge property listing inquiries go directly to advertisers, that the advertiser will receive your contact information, that you should review advertiser privacy policies before submitting, and that HALP is not responsible for how advertisers handle your information.

17.5 Advertiser Obligations

Listing agents and advertisers agree to handle inquiries in accordance with privacy laws, maintain their own privacy policy, use information only for legitimate business purposes, not spam or harass prospective customers, and comply with Australian Consumer Law.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is invalid, it will be limited or eliminated to the minimum extent necessary and remaining provisions continue in force. Our failure to enforce any provision does not waive future enforcement. You may not assign your rights without our consent. Notices may be sent by email, website post, or in-app notification. These Terms are written in English; translations are for convenience only.

13. Special Terms for Specific Services

Mortgage Calculators provide estimates only using standard assumptions and do not replace professional financial advice. Actual loan terms are determined by lenders. School Zone Data is aggregated from public databases, provided "as is", and school zone boundaries change frequently — always verify with the relevant education department and school. Enrolment is not guaranteed. Property Alerts are sent based on your saved criteria and may be modified or cancelled anytime. Home Loan Referrals may earn HALP a referral fee; brokers are independent and must comply with responsible lending laws.

Platform: All HALP websites, mobile applications, and related services. User: Any person or entity that accesses or uses our services. Content: All information, text, images, data, software, and materials on our platforms. Property Provider: Developers, builders, real estate agents and others listing properties.
